Article 5 deals with the determination of citizenship at the time of the commencement of the Indian Constitution, which was on January 26, 1950. It specifies that at the commencement of the Constitution, every person who had his domicile in the territory of India and Who was born in the territory of India; or Either of whose parents was born in the territory of India; or Who had been ordinarily resident in the territory of India for not less than five years immediately preceding the commencement of the Constitution, shall be a citizen of India. This article lays the foundation for the citizenship criteria for individuals as of the commencement of the Constitution. The subsequent articles in the Constitution, particularly Articles 6 to 11, further elaborate on matters related to citizenship, including provisions for migration and the rights of citizenship.
